2. Description of Services

RestoAnswer provides AI-powered phone answering services for restaurants, including but not limited to:

Answering incoming phone calls

Taking pickup and delivery orders

Booking reservations

Sending SMS confirmations and reminders

RestoAnswer acts as a call handling and communication tool, not as the restaurant itself.

3. Eligibility

You must be at least 18 years old and authorized to act on behalf of a business to use the Services.

4. Account Responsibilities

Restaurant clients are responsible for:

Providing accurate menu, hours, pricing, and reservation rules

Keeping restaurant information up to date

Monitoring orders and reservations received through the Service

RestoAnswer is not responsible for errors caused by incorrect or outdated information provided by the restaurant.

5. Call Handling, AI Use & Recordings

Calls may be:

Answered by an AI system

Recorded and transcribed for operational and quality purposes

By using the Services, you consent to call recording and AI processing. Restaurants are responsible for complying with any local notice or consent requirements related to call recording.

6. Orders and Reservations

RestoAnswer facilitates the capture and transmission of orders and reservations but does not:

Prepare food

Guarantee order fulfillment

Control pricing, availability, or preparation times

All orders and reservations are fulfilled solely by the restaurant.

7. SMS Communications

Use of the Services may include transactional SMS messages such as:

Order confirmations

Reservation confirmations

Reservation reminders

Message frequency varies. Standard message and data rates may apply. RestoAnswer is not responsible for carrier delays or message failures.

8. Payments and Fees

Restaurant clients agree to pay all applicable subscription fees as agreed at signup.

Unless otherwise stated:

Fees are billed monthly

Fees are non-refundable

Failure to pay may result in suspension or termination of service

Pricing may change with notice.

9. Service Availability

While we strive for high availability, RestoAnswer does not guarantee uninterrupted or error-free service. Temporary outages may occur due to maintenance, system updates, or factors beyond our control.

10. Acceptable Use

You agree not to:

Use the Services for unlawful purposes

Attempt to reverse engineer or misuse the platform

Interfere with system performance or security

We reserve the right to suspend or terminate service for misuse.

11. Intellectual Property

All software, branding, trademarks, and content related to RestoAnswer are owned by RestoAnswer or its licensors. You may not copy, modify, or distribute any part of the Services without written permission.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.”
We make no warranties regarding:

Accuracy of AI responses

Volume of calls or orders

Increased revenue or business performance

Use of the Services is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, RestoAnswer shall not be liable for:

Lost profits or revenue

Missed orders or reservations

Business interruption

Indirect or consequential damages

Our total liability shall not exceed the fees paid by the client in the preceding three (3) months.

14. Indemnification

You agree to indemnify and hold harmless RestoAnswer from any claims, damages, or liabilities arising from:

Your use of the Services

Your restaurant’s operations

Food quality, preparation, or delivery

15. Termination

Either party may terminate service according to the agreed billing terms. Upon termination, access to the Services may be disabled.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which RestoAnswer operates, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
